The law on same-sex sexual activity

Hawaii revoked sodomy laws in April 1972 and revised the sexual violation law in 1986 following a state Supreme Court ruling that defended Georgia's ban on sodomy. The revocation of the original sodomy law took effect in early 1973.

On September 9, 2013, Governor Abercrombie announced that he called the Hawaii State Legislature into a special session on October 28 to consider same-sex marriage bills. The bill has wide support in the Senate as well as the majority needed in the House. If approved, the bill will take effect November 18.

On October 28, the Senate Committee on Justice and Labor passed a same-sex marriage law in a 5-2 vote, sending the bill to the full Senate vote. On October 30, the Senate approved the law in the 20-4 vote, sending the bill to the House. On 31 October, the bill was disputed by the Committee of the Justice and Financial Committee. The House of Representatives, after a vast public debate and the 'citizens' filibuster' act of law, voted 30-19 on November 8 in favor of legislation. The bill returned to the Senate for approval of the House amendment extending the religious exemption and the Senate gave final legislative approval on Nov. 12, a 19-4 vote for the section to the governor's table. Governor Neil Abercrombie signed the bill into law on 13 November; same-sex couples start getting married on December 2, 2013.

Pre-marital history of same sex

Hawaii's denial of marriage certificates for the same couple was challenged in court in 1993. In 1994, the state enacted laws prohibiting same-sex marriage. In November 1998 Hawaii voters voted 69 percent in favor of a constitutional amendment of the so-called Hawaii State Constitution Amendment 2 to allow the legislature to ban same-sex marriage. The constitutional amendment led the Supreme Court of Hawaii to annul the lawsuit.

Hawaii established mutual reciprocity, limited forms of civil union, for same-sex couples and opposite sexes in 1997. Many legislative efforts to enact a fuller civil union equivalent to other civil jurisdictions and domestic jurisdiction have failed.

Governor Linda Lingle vetoed civil law in 2010. Governor Neil Abercrombie signed the same law on 23 February 2011, the first law he signed as governor. The law comes into force on 1 January 2012.

Hawaii has been benefiting its nation-wide counterparts since 1997.

Parenting

Hawaii allows all couples, including same-sex couples to adopt. In addition, lesbian couples can gain access to IVF and artificial insemination treatments and surrogacy is allowed for gay male couples as well.

Protection of discrimination

Hawaii's law explicitly prohibits discrimination based on sexual orientation and gender identity or expression in employment, public accommodation and housing.

Protection of discrimination for sexual orientation in employment was added in 1991. In 2005 protection was extended to housing and in 2006 for public accommodation, both for sexual orientation and gender identity or expression. In 2011, gender identity or expression protection is extended for work.

Hates crime laws

Hawaii has laws that address the protection of hate crimes for sexual orientation and gender identity or actual and/or perceived expression.

By law:

  • Sexual orientation is defined as heterosexuality, homosexuality or bisexuality and they "have a history of one or more of these preferences or identified with one or more of these preferences."
  • "'Gender identity or expression' includes an actual or perceived gender, as well as a person's gender identity, gender-related self-image, gender-related appearance, or gender-related expression Regardless of whether the gender identity, gender-related self-image, gender-related appearance, or gender-related expression is different from that traditionally associated with a person's gender at birth. Conversion therapy

Since 2013, several bills have been introduced in Hawaii to prohibit legal conversion therapy in minors, but the bill does not exist or does not exist for years.

Birth certificate gender identity and gender reassignment

The Hawaiian Health Department issued a new birth certificate to a postoperative transsexual after receiving a doctor statement verifying that the birth registrar had undergone a sex change operation. On May 5, 2015, the Hawaii Legislature passed a bill to allow transgender people to change their gender on their birth certificate without undergoing such an operation. Hawaii Governor David Ige signed the bill into law on July 14, 2015 and the law came into force immediately.

Since July 1, 2016, Hawaii also prohibits discrimination against gender identity or expression in insurance contracts. This should also include gender reassignment operations.
