The application of second parent adoption or with parent is the process by which a marriage partner can adopt a biological child or his or her adoption from a partner without terminating the parent's legal right. This issue is very important in the context of LGBT adoption.

In the United States, the adoption of a second parent was initiated by the National Center for Lesbian Rights (formerly the Lesbian Rights Project) in the mid-1980s. California State, Washington, DC, Vermont (1993), Washington State and Washington, DC explicitly allow the adoption of second parents by same-sex couples across the state, either by law or court decision. In May 2007, Colorado allowed the adoption of second parents by same-sex couples. In 2013, Michigan law allows the adoption of second parents for married couples, while prohibiting same-sex marriage. The latest ban was beaten by the Supreme Court in 2015.

Courts in many other states have also given adoption of second parents to same-sex couples, although there are no statewide laws or court decisions that guarantee this. In fact, courts within the same country but in different jurisdictions often contradict each other in practice.

The American Medical Association supports the adoption of second parents by same-sex couples, stating that a lack of formal recognition may lead to disparities in health services for children of same-sex parents.

The American Academy of Pediatrics supports the adoption of second parents.

In July 2011, Slovenia's Ministry of Labor, Family and Social Affairs stated that the existing law allows the adoption of second parents.

In the context of LGBT adoption and care in Australia, In 2008, the best option was to apply to the Australian Family Court for parenting orders, as 'others important to the child's care, welfare and development'. It provides an important "status quo" if the biological mother dies, preventing other family members from taking direct custody of the child.
