Lesbian, gay, bisexual, and transgender (LGBT) people in the US state of Montana face some legal challenges not experienced by non-LGBT residents. Sexual sexual activity is legal in Montana. Couples and families led by same-sex couples are not eligible for all the protections available to different couples.

Montana revised its criminal code in 1973 and defended anti-sodomy laws. Efforts to repeal the country's sodomy law failed in 1991. The Montana Supreme Court was held at Gryczan v. State (1997) that state legislation prohibiting same-sex sexual contact between consenting adults is unconstitutional.

The attempt to revoke the law failed in 2011.

On February 20, 2013, the Montana State Senate passed a law, with a voice of 38 to 11 votes, annulling part of the deviant sexual behavior laws dealing with approved adults. On April 10, 2013, the Montana Board of Representatives passed the bill with a voice of 64 to 35 votes. On April 18, 2013, Governor Steve Bullock signed the sodomy decriminalization law.

The federal court ruled a state ban on unconstitutional unconstitutional marriage on November 19, 2014. Judge Brian Morris issued an order against the state's enforcement of its immediate ban. The state appeal to the Ninth Circuit Court of Appeals was disputed when the US Supreme Court ruled on June 26, 2015 that Ohio's ban on same-sex marriage was unconstitutional, beating every remaining state ban.

Montana voters have adopted a constitutional amendment in November 2004 that defines marriage as a union of men and women. Similar restrictions appear in state law.

Adoption and parenting

Montana allows the adoption by individuals. There is no explicit prohibition on adoption by same-sex couples or second-parental adoption by persons of the same sex as the first parent. In Kulstad v. Maniaci, Barbara Maniaci tried to refuse to allow Michelle Kulstad to see the children they collected together and had been legally adopted only by Maniaci, but the courts sided with Kulstad and granted custody to the parents. The Supreme Court of Montana confirmed this ruling 6-1 on October 7, 2009, setting a precedent that allows future adoption of stepparents by same-sex couples.

Protection of discrimination

Montana, by executive order, prohibits discrimination on the biases of sexual orientation and gender identity only in the employment and contracting countries (sub). In 2000, Governor Marc Racicot first issued state personnel regulations prohibiting discrimination and harassment on the basis of work-related sexual orientation by the state government. In November 2008, Governor Brian Schweitzer issued Executive Order No. 41-2008, extends the state non-discrimination provisions of the state. In January 2016, Governor Steve Bullock extended the protection to protect gender identity and expand it to state contractors and subcontractors.

On February 23, 2011, the Montana Representative Council passed, with a voice of 62-37 votes, a bill that would ban local municipalities from adopting an anti-discrimination policy that is not protected by state law. On April 28, 2011, the bill died at the Montana State Senate Standing Committee.

The following Montana cities have ordinances that prohibit discrimination on the basis of sexual orientation and gender identity: Bozeman, Butte, Helena and Missoula, and Missoula County.
